2016 FLSA Overtime Rule

The Department of Labor’s new rule amending the Fair Labor Standards Act (FLSA) overtime pay exemption regulations will go into effect December 1, 2016. The new overtime rule increases the minimum salary threshold for exempt employees from $23,660 per year ($455 per week) to $47,476 per year ($913 per week). Additionally, the DOL is mandating subsequent increases in the minimum salary threshold every three years, with the first increase to occur on January 1, 2020.

Starting November 20, 2016, all UC academic personnel, including rehired retirees and part-time employees, who do not qualify for the professional teaching exemption and who earn less than $913 per week or $47,476 per year, will be reclassified as non-exempt and paid on an hourly basis.
